 Azerbaijan Committee against Tortures (ACAT) was founded in 2002, and was officially registered by the Ministry of Justice of Azerbaijan in 2005. Purpose of the organization is to organize defense of human rights, to discover victims of tortures, after discovering to organize juridical aid to them, to expose the employees of force structures, to monitor the conditions in detention institutions under subordination of Ministry of Justice, Ministry of Internal Affairs, Ministry of National Security and Ministry of Defense and prisoners in those institutions. Director of the Committee Mr. Elchin Behbudov took part and spoke on theme “Human rights and tortures” in international conferences held by International Organization of Prison Reforms in Bakuriani city of Georgia on February 14-17, 2005 and in Vienna, Austria on 14-17 July, 2005 by the support of OCSE.

E. Behbudov is the expert of OSCE on monitoring of detention centers at law-enforcement bodies. And OSCE is the longterm partner of Azerbaijan Committe Against Tortures.

The local NGO Democratic Instutions and Human Right Public Union lead by Elchin Abdullayev is the longterm partner of Azerbaijan Committe Against Tortures.

Elchin Behbudov meets with Mushfig Huseynov

Chief of Azerbaijani Committee against Torture Elchin Behbudov visited jails #2 and 16 of the Penitentiary Service, the human rights defender told APA. He said that he had met with the correspondent of Bizim yol newspaper Mushfig Huseynov in jail #2. The human rights defender said the journalist suffered tuberculosis and did not feel well. Behbudov said he had appealed to President Ilham Aliyev in connection with Mushfig Huseynov’s disease. The committee chief said he had asked the President to help release the journalist.

The human rights defender said he had also met with Kazimov Vasif Mammadhasan, 50, in jail #16 at the request of his family. Behbudov said Kazimov could be released because of his disease. Elchin Behbudov said he had appealed to the president in connection with it.

Elchin Behbudov meets with imprisoned editor-in-chief of “Tolishi Sedo”

 Editor-in-chief of “Tolishi Sedo” newspaper Novruzali Mammadov, who had been out into the punishment cell for his rude attitude towards the jail warden in jail #15, was released, chief of Azerbaijan Committee against Torture Elchin Behbudov told APA. The committee chief said he had visited jail #15 and met with the prisoner. Behbudov said Novruzali Mammadov was put into punishment cell on January 15 for his rude attitude towards the jail warden.

“67-year-old prisoner complained of his health problems. I informed the jail administration about it and the editor-in-chief was released from the punishment cell earlier,” he said.

Editor-in-chief of “Tolishi Sedo” newspaper Novruzali Mammadov faced charges under Article 274 (high treason) and Article 283 (excitation of national, racial or religious hostility) of the Criminal Code. Court of Grave Crimes sentenced the editor-in-chief to 10 years in jail.

 



















Elchin Behbudov visits detention facility and jail

Baku – APA. Chief of Azerbaijan Committee against Torture Elchin Behbudov has visited detention facility #3 in Shuvalan. Behbudov told APA that he visited the jail basing on the complaints of four defendants. Elchin Behbudov said they did not complain of detention conditions, but of torture and pressure of inspectors.
The committee chief said he also met with editor-in-chief of Talishi-sedo newspaper Novruzali Mammadov in jail #15. He suffered from dyspnea, but did not accept the proposal to be transferred to Justice Ministry’s Medical Facility.
“He wanted to be treated in the medical unit of the jail. Under the order of the jail chief, Novruzali Mammadov was transferred to the medical unit,” he said.

Azpenalreform.az -Chairman of Azerbaijan Anti-Torture Committee, Elchin Behbudov monitored Hajıgabul, Ujar, Kurdamir, Zardab, Goychay and Agsu regional police departments. He informed mass media that, during the monitoring he observed repair work carried out in pre-trial jails of Ujar and Kurdamir regional police departments and there were no serious problems in others. The right defender investigated the reasons for detention of owner Chingiz Mayilov in Goychay region. According to E. Behbudov, Ilgar Eyyubov, inspector of the police department who carried out preliminary inquiry acquainted him with the case.

Saying C. Mayilov was held in Ganga pre-trial jail No. 2 of the Penitentiary Service, E. Behbudov stressed the work is given under jurisdiction of Inquiry Department of Interior Ministry. 

 

Last Meetings

ACAT intensifies cooperation with international organizations in order to develop its activity and held meetings for this purpose. Heads of ACAT held meeting with Ms. Miriam Lanksoy, USA donor organization Senior Program Officer of the Caucasus and Central Asia and discussed cooperation perspectives.

 

Democratic Institutions and Human Rights Social Union and Azerbaijan Committee Against Torture held meeting with Mr. Vladlen Stefanov, representative on the Caucasus and Middle Asia of UN. Human rights and freedoms, torture facts and torture victims were discussed in this meeting.

 




The head members of ACAT held meeting with Mrs. Susan Treadvell, deputy of the Human Rights and Governance Program of Budapest Office of Open Society Institute and with Mrs. Magda Adamovich, program coordinator of the same program. The situation in Prisons of Azerbaijan was discussed in the meeting.

 




The chairman, the famous expert of Helsinki Committee of Bulgaria Mr. Krassimir Kinev arrived in Azerbaijan with the invitation of ACAT. He held training to committee representatives regarding monitoring in prisons. Then he held monitoring in the strict regime prison of Penitentiary Office of Ministry of Justice and talked with prisons individually.

 


FINAL REPORT OF AZERBAIJAN COMMITTE AGAINST TORTURE FOR 2007

  I. List of the citizens executed by torture. 

1.  Kamilov Imran Samandar oglu – born in 1988, resident of Ismayilli city. At first he was undergone the torture and then executed in the military unit No N of the Ministry of Defense of the Republic of Azerbaijan at about 23 o’clock on February 18, 2007. According to Kamala Karman Samander oglu, his brother Tillman Akbar, senior lieutenant, company commander and Khudaverdiyev, senior lieutenant, platoon commander are guilty in the death of Imran.  

2.  Mirzayev Vidadi Yadulla oglu – born in 1960, resident of Jalilabad city. He died in the Treatment Institution of the Penal Service of the Ministry of Justice on May 24, 2007. According to his mother Mirzayeva Sayyara Mirkazim gizi, Vidadi was arrested by the employees of the Police Department of Jalilabad district in the middle of May, he was sent to Baku on May 23, and his dead body was sent to morgue at about 14 o’clock on May 24, she was notified about this information by telegram on May 26, then the dead body delivered to them at 00:45 on May 27 under closed cover.

II. List of the citizens subjected to the torture.

1. Aghayev Famil Misirkhan oglu – born in 1987, resident of Aghdam region. He was subjected to severe torture as if while rendering espionage service to the Armenians in the military unit No N of the Ministry of Defense of the Republic of Azerbaijan on February 29, 2007, was beaten by delivering a heavy blows by fists and kicks, truncheon to the different regions of his body, and was kept hunger for a days.

2. Huseynov Fuad Ogtay oglu – resident of Ujar region. He was subjected to severe torture by Anvar Guliyev, chairman of Police Department of Ujar region on May 29, 2007. According to his complaint to our Committee about being subjecting to the torture under the order of Anvar Guliyev he was beaten severely by Mahmud Magsudov, investigator and outraged. .

3. Jamiyev Shamsaddin Gurbat oglu – born on June 12, 1957, resident of Guba region. Sh.G.Jamiyev, invited to the meeting during annual report of the Gajar Zeyid village municipality of Guba region on January 21, 2007 asked in the beginning of the meeting to conduct the meeting under the requirements of the law and to put the problem related to the condition of the fruit gardens of 10 ha which is in the balance of the minicipality to the agenda.

LEGISLATION

Azerbaijan Republic Constitution and Legislation, as well as international legal standard acts and Conventions that Azerbaijan joined, prohibit torture and provide measures for its prevention. Notably, in the Article 46 of Azerbaijan Republic Constitution provides:

1) Every one has rights to prevent his/her dignity and honor

2) No one would be subjected to torture and agony. No one would be undergone to medical or scientific examination.
